1. Introduction

Welcome to DukaniKwangu. These Terms of Service ("Terms") govern your use of our website located at www.dukanikwangu.store (the "Platform") and our related services.

By accessing or using our Platform, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Platform.

2. Definitions

• "Platform" refers to the DukaniKwangu website and services.
• "User" refers to any person who accesses or uses the Platform.
• "Customer" refers to users who purchase products through the Platform.
• "Seller" refers to businesses that list and sell products on the Platform.
• "Products" refers to goods listed for sale on the Platform.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms.

You are responsible for safeguarding the password and for all activities that occur under your account. You must notify us immediately upon becoming aware of any breach of security.

4. Purchases and Payments

All purchases are subject to product availability. We reserve the right to refuse or cancel any order for any reason.

Prices for products are subject to change without notice. We accept various payment methods including mobile money (M-Pesa, Tigo Pesa, Airtel Money) and cash on delivery.

By placing an order, you represent that the payment information you provide is accurate and that you are authorized to use the payment method.

5. Shipping and Delivery

Delivery times are estimates and not guaranteed. DukaniKwangu is not responsible for delays caused by shipping carriers or unforeseen circumstances.

Risk of loss and title for products pass to you upon delivery. It is your responsibility to ensure someone is available to receive the delivery.

6. Returns and Refunds

You may request a return within 7 days of delivery for most products, provided they are in original condition with tags attached.

Certain items are non-returnable including perishable goods, personal care items, and customized products. Sellers may have their own return policies which will be indicated on product pages.

Refunds will be processed within 14 business days after we receive and inspect the returned item.

7. Seller Responsibilities

Sellers are responsible for the accuracy of product listings, maintaining adequate inventory, fulfilling orders promptly, and handling customer inquiries related to their products.

DukaniKwangu acts as a marketplace platform and is not the seller of products. Any contract for sale is directly between the Customer and the Seller.

8. Intellectual Property

The Platform and its original content, features, and functionality are owned by DukaniKwangu and are protected by copyright, trademark, and other intellectual property laws.

9. Limitation of Liability

DukaniKwangu shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or any products purchased through it.

Our total liability shall not exceed the amount you paid for the relevant product or service.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Republic of Tanzania, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
